Terms of Service

PLEASE READ THESE TERMS CAREFULLY BEFORE USING OGNIMOHUB SERVICES

By creating an account, accessing, or using any Ognimohub platform, application, or service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable policies incorporated herein by reference. If you do not agree to these Terms, you must not use our services.


1. Introduction

Ognimohub ("Ognimohub", "we", "our", or "us") is a licensed Mobile Finance Service (MFS) provider and technology company operating the Ognimohub platform — a comprehensive financial ecosystem accessible via web, mobile applications, APIs, and associated sub-platforms including Bitara (trade.ognimohub.com), and Academy (ognimohub.co.ke).

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Ognimohub governing your access to and use of all Ognimohub services, platforms, applications, APIs, content, and features (collectively, the "Services"). These Terms apply to all categories of users, including Personal Users, Merchants, Agents, and Developer API consumers.

Ognimohub operates in compliance with applicable financial regulations, data protection laws, and industry standards across the jurisdictions it serves. Our services are continuously evolving, and we reserve the right to update these Terms as described in Section 22.


2. Definitions

The following defined terms are used throughout these Terms:

  • "Account" means a registered user, merchant, or agent profile on any Ognimohub platform.

  • "Agent" means an individual or entity authorized by Ognimohub to provide Cash In, Cash Out, float management, and related services on behalf of Ognimohub in designated locations.

  • "AML" means Anti-Money Laundering — regulations and controls to prevent the proceeds of crime from being processed.

  • "API" means Application Programming Interface — the Ognimohub developer interface enabling third-party integration with Ognimohub services.

  • "CFT" means Countering the Financing of Terrorism.

  • "Digital Wallet" means the electronic wallet associated with a User's Ognimohub account holding available balances.

  • "KYC" means Know Your Customer — the identity and due diligence verification process required by financial regulations.

  • "Merchant" means a business or individual registered on the Ognimohub platform to accept payments, manage collections, and access business financial tools.

  • "MFS" means Mobile Finance Service — digital financial services accessible via mobile and web platforms.

  • "Personal User" means an individual who registers for a personal Ognimohub account for personal financial transactions.

  • "Platform" means the Ognimohub website, mobile applications, web dashboards, APIs, and all associated sub-platforms.

  • "PSP" means Payment Service Provider — third-party providers whose payment rails Ognimohub integrates to facilitate transactions.

  • "Services" means all products, features, tools, APIs, and functionalities made available by Ognimohub.

  • "Transaction" means any financial operation initiated through the Platform, including but not limited to payments, transfers, deposits, withdrawals, bill payments, and investments.

  • "Virtual Card" means a digitally issued payment card linked to a User's Ognimohub account for online transactions.


3. Eligibility and Account Registration

3.1 Eligibility Requirements

To register for and use Ognimohub Services, you must:

  • Be at least 18 years of age or the legal age of majority in your jurisdiction, whichever is higher.

  • Have the legal capacity to enter into a binding contract under the laws of your jurisdiction.

  • Not be a resident of, or subject to the sanctions laws of, any jurisdiction where the use of our Services is prohibited or restricted.

  • Not have been previously suspended, terminated, or banned from any Ognimohub platform.

  • Comply with all applicable laws and regulations in your jurisdiction relating to the use of financial services platforms.


3.2 Account Registration

To access Ognimohub Services, you must create an account by providing accurate, current, and complete information as requested during the registration process, including your full legal name, valid mobile number or email address, and any other information required for your account category.

You agree to maintain and promptly update your account information to keep it accurate and current. You are solely responsible for all activities that occur under your account. Ognimohub reserves the right to refuse registration or suspend accounts where information is found to be inaccurate, misleading, or in violation of these Terms.


3.3 Account Types

Account Type

Description & Primary Use Case

Personal User

Individuals accessing MFS services for personal financial management, payments, transfers, savings, and investments.

Merchant

Businesses and sole traders integrating Ognimohub to accept payments, manage collections, issue payment links, and access business analytics.

Agent

Authorized field representatives providing Cash In, Cash Out, mobile money, and financial access point services to end users.

Developer / API User

Businesses and developers integrating Ognimohub APIs into third-party applications, platforms, and enterprise systems.


3.4 KYC Verification

In compliance with applicable AML/CFT regulations and financial industry standards, Ognimohub requires all users to complete KYC (Know Your Customer) identity verification before accessing certain features, transaction limits, or services. The KYC process may require:

  • Government-issued photographic identification (national ID, passport, or driver's licence).

  • Proof of address (utility bill, bank statement, or equivalent, dated within 90 days).

  • Selfie or biometric facial verification.

  • Business registration documents (for Merchant and Agent accounts).

  • Source of funds declaration (for higher-tier accounts or elevated transaction limits).

Ognimohub reserves the right to impose transaction limits, restrict services, or suspend accounts pending satisfactory completion of KYC verification. KYC requirements may be enhanced from time to time in response to regulatory updates.


3.5 Account Security

You are responsible for maintaining the confidentiality and security of your login credentials, including your password, PIN, and any multi-factor authentication (MFA) codes. You must not share your credentials with any third party. You agree to notify Ognimohub immediately at support@ognimohub.com if you suspect unauthorized access to your account or any security breach. Ognimohub shall not be liable for any losses arising from your failure to maintain account security.


4. Description of Services

Ognimohub provides a multi-layered financial ecosystem offering the following services across its platform. All services are subject to availability in your region, applicable regulatory permissions, and compliance with these Terms.


4.1 Personal Financial Services

  • Add funds to your Ognimohub digital wallet using over 20 supported payment gateways including Stripe, PayPal, and local payment options. Deposits:

  • Transfer funds instantly and securely to other Ognimohub users or external recipients. Send Money:

  • Send money directly to bank accounts domestically and internationally, with full SWIFT/BIC support for cross-border transfers. Bank Transfer:

  • Withdraw funds from your wallet to linked bank accounts or designated cash-out methods. Cash Out:

  • Top up mobile credit for all major carriers directly from the platform. Mobile Recharge:

  • Pay utility bills including electricity, water, gas, and internet services. Bill Payments:

  • Pay tuition and institutional fees securely to supported educational institutions. Education Fee Payments:

  • Make donations to verified charitable causes via the platform. Donations:

  • Access microcredit, micro-insurance, and micro-leasing products tailored to individual financial needs. Microfinance:

  • Generate digitally issued payment cards for secure online transactions without exposing primary account details. Virtual Cards:

  • Access periodical investment plans to grow personal wealth through Ognimohub's integrated investment products. Investments:

  • Purchase digital gift cards for major platforms including Netflix, Amazon, Google Play, and Binance. Gift Cards:

  • Seamlessly exchange between different payment gateways to enable cross-border transactions across unsupported regions. Gateway Swap:

  • Request funds from other Ognimohub users with trackable, transparent request management. Money Request:


4.2 Business and Merchant Services

  • Accept payments from Ognimohub users and external customers via mobile wallets, bank transfers, and supported payment channels. Payment Acceptance:

  • Generate unique shareable payment URLs for e-commerce and invoice collection without full platform integration. Payment Links:

  • Full-featured API suite for integrating Ognimohub financial services into custom platforms, applications, and enterprise systems. Developer API:

  • Access detailed customer payment logs, purchasing behaviour analytics, and dispute management tools. Transaction Management:

  • Create and manage customer promotions, discount campaigns, and loyalty incentives from a centralized merchant dashboard. Promotions & Discounts:

  • Configure subscription billing and recurring payment schedules for membership and instalment models. Recurring Payments:

  • Accept global payments from customers in multiple currencies via integrated PSP partners. International Payment Collection:

  • Access real-time transaction reports, revenue analytics, and reconciliation tools. Reporting and Analytics:


4.3 Agent Services

  • Accept physical cash deposits from customers and credit equivalent amounts to their Ognimohub digital wallets. Cash In:

  • Disburse physical cash to customers upon digital wallet debit instructions. Cash Out:

  • Fund and manage agent float accounts to ensure continuous service availability. Float Management:

  • Download detailed transaction statements for accounting, audit, and compliance purposes. Statement Access:


4.4 Sub-Platform Services

  • Ognimohub's cryptocurrency and digital asset trading platform. Bitara (trade.ognimohub.com):

  • Ognimohub's e-Learning platform offering financial literacy, technology, and professional development courses. Academy (ognimohub.co.ke):

  • Ognimohub's capital and investment management sub-platform. Capitus (capital.ognimohub.com):

  • Centralized user portal for account management, profile settings, and service access. My Portal (ognimohub.com/verify):

Each sub-platform may be subject to additional terms specific to that service. In the event of a conflict between sub-platform-specific terms and these Terms, the sub-platform terms shall prevail with respect to the relevant service.


5. Fees, Charges, and Pricing

5.1 Service Fees

Ognimohub may charge fees for certain transactions and services. Applicable fees will be clearly disclosed to you prior to the completion of any transaction. By confirming a transaction, you consent to the deduction of any applicable fees from your account balance or transaction amount.

Fees may vary depending on your account type, transaction type, geographic location, payment method, partner PSP, and applicable promotional rates. Ognimohub reserves the right to amend its fee schedule at any time with reasonable prior notice, as described in Section 22.


5.2 Currency Conversion

Where transactions involve currency conversion, Ognimohub or its PSP partners will apply an exchange rate at the time of the transaction. The applied exchange rate may include a margin above the base interbank rate. The applicable rate and any conversion fees will be disclosed before transaction confirmation.


5.3 Third-Party Charges

Certain transactions processed through third-party PSPs, banks, or payment networks may attract additional charges imposed by those third parties. Ognimohub is not responsible for third-party fees and recommends that users verify applicable charges with their financial institutions.


5.4 Refunds and Disputes

Refund eligibility and transaction dispute procedures are governed by Ognimohub's Transaction & Refund Policy, available at:

Refund requests must be submitted within the timeframes specified in the Transaction & Refund Policy. Ognimohub is not obligated to issue refunds for completed, irreversible transactions unless an error attributable to Ognimohub is demonstrated.


6. Digital Wallet and Stored Value

6.1 Nature of the Digital Wallet

The Ognimohub digital wallet is a stored-value electronic payment instrument enabling users to hold, send, receive, and transact using pre-loaded funds. The balance held in your digital wallet is not a bank deposit and does not accrue interest unless expressly offered through a specific Ognimohub investment product.


6.2 Wallet Funding and Limits

Wallet funding is subject to minimum and maximum balance limits, daily transaction caps, and periodic review thresholds determined by Ognimohub in accordance with regulatory requirements and your KYC verification tier. Ognimohub reserves the right to adjust applicable limits without prior notice where required by law or risk management obligations.


6.3 Dormancy

An account is considered dormant if no transaction has been initiated for a continuous period of 12 months or such period as prescribed by applicable regulation. Ognimohub may impose dormancy fees, restrict account functionality, or transfer dormant wallet balances to a designated regulatory account in accordance with applicable unclaimed assets legislation. Users will be notified prior to any dormancy-related action.


6.4 Wallet Closure and Balance Withdrawal

Upon account closure or deletion, any positive wallet balance must be withdrawn to a verified external account or method prior to closure. Ognimohub will not be responsible for wallet balances that cannot be disbursed due to unverified account details, outstanding holds, or regulatory restrictions.


7. Virtual Cards

Virtual cards issued through Ognimohub are digital payment instruments linked to your wallet balance and designed exclusively for online and card-not-present transactions. Virtual cards are subject to the following conditions:

  • Virtual cards are non-transferable and may only be used by the registered account holder.

  • Transaction limits, accepted merchants, and geographic availability are determined by Ognimohub and the issuing card network.

  • Virtual cards may be suspended or cancelled by Ognimohub at any time in response to suspected fraud, suspicious activity, or violations of these Terms.

  • Virtual card details (card number, CVV, expiry) must be kept confidential. Ognimohub accepts no liability for unauthorized use resulting from user disclosure of card details.

  • Virtual cards are not physical cards and cannot be used for in-person point-of-sale transactions unless specifically enabled.


8. Agent-Specific Terms and Obligations

Agents are authorized representatives of Ognimohub for the purposes of providing Cash In, Cash Out, and related agent banking services. In addition to these general Terms, Agents are subject to the following specific obligations:

  • Agents must complete Ognimohub's full onboarding process, including KYC verification, business documentation review, and agent training certification.

  • Agents must maintain sufficient operational float at all times to meet anticipated customer transaction volumes.

  • Agents must operate exclusively within the transaction limits, service boundaries, and geographic zones designated by Ognimohub.

  • Agents must not charge customers fees in excess of Ognimohub's published agent fee schedule.

  • Agents must maintain accurate transaction records and make them available for Ognimohub audit at any time.

  • Agents must immediately report suspected fraud, suspicious customer activity, or system anomalies to Ognimohub.

  • Agents must not engage in unauthorized sub-agency arrangements without Ognimohub's prior written consent.

  • Agent status may be revoked by Ognimohub at any time for breach of these Terms, regulatory non-compliance, or reputational risk.


9. Merchant-Specific Terms and Obligations

Merchants registered on Ognimohub's platform agree to the following additional obligations:

  • Merchants must provide accurate and complete business registration information and maintain current business details on their merchant profile.

  • Merchants must only accept payments for lawful goods and services. Ognimohub prohibits the use of its merchant services for illegal, restricted, or prohibited business categories.

  • Merchants must comply with all consumer protection laws, refund obligations, and dispute resolution requirements applicable in their jurisdiction.

  • Merchants using Ognimohub's payment collection services are responsible for maintaining their own PCI DSS compliance obligations applicable to the cardholder data they independently handle.

  • Merchants are responsible for the accuracy of payment links, amounts, and descriptions issued to customers.

  • Merchants must not engage in fraudulent transactions, chargeback manipulation, or payment processing in violation of applicable card network rules.

  • Ognimohub reserves the right to withhold, suspend, or reverse merchant settlements where fraud, disputed transactions, or regulatory obligations require it.


10. Developer API Terms

10.1 API Access and Licensing

Access to the Ognimohub Developer API is granted subject to these Terms and any additional API-specific terms provided in Ognimohub's developer documentation. API access constitutes a limited, non-exclusive, non-transferable, revocable license to integrate Ognimohub's Services into authorized third-party applications.


10.2 Developer Obligations

  • API users must comply with Ognimohub's published API documentation, rate limits, and acceptable use guidelines.

  • API integrations must not be used to circumvent Ognimohub's transaction monitoring, KYC requirements, or fraud detection systems.

  • Developer applications using Ognimohub's API must provide their own end-user terms and privacy policy disclosures.

  • API credentials (API keys, tokens) must be kept confidential and not shared or exposed in client-side code.

  • API users are responsible for ensuring that their applications comply with all applicable laws in the jurisdictions where they operate.


10.3 API Rate Limits and Fair Use

Ognimohub imposes rate limits on API calls to ensure platform stability. Excessive API usage that degrades platform performance for other users may result in temporary rate limiting, suspension of API access, or termination of API credentials without prior notice.


11. Acceptable Use and Prohibited Conduct

11.1 Acceptable Use

You agree to use Ognimohub Services only for lawful purposes and in accordance with these Terms. You are solely responsible for all transactions, content, and activities conducted through your account.


11.2 Prohibited Activities

The following activities are strictly prohibited on the Ognimohub platform. Violation may result in immediate account suspension, termination, fund freezing, and referral to relevant authorities:

  • Money laundering, terrorist financing, or any transaction designed to conceal the origin of illegally obtained funds.

  • Fraud, identity theft, phishing, or any misrepresentation of identity in connection with account registration or transactions.

  • Unauthorized access to or interference with Ognimohub systems, databases, or infrastructure.

  • Use of Ognimohub services to purchase or sell illegal goods, prohibited services, or controlled substances.

  • Processing payments for gambling, adult content, weapons, counterfeit goods, or other restricted categories without prior written authorization from Ognimohub.

  • Creating multiple accounts to circumvent transaction limits, KYC requirements, or account restrictions.

  • Reverse engineering, decompiling, scraping, or attempting to extract proprietary data from Ognimohub's platform or APIs.

  • Using automated bots, scripts, or tools to access Ognimohub services in an unauthorized manner.

  • Engaging in transaction structuring (smurfing) to avoid AML reporting thresholds.

  • Transmitting malicious code, viruses, or disruptive software through the platform.

  • Violating any applicable laws, regulations, or third-party rights in connection with the use of Ognimohub services.


12. AML/CFT Compliance and Transaction Monitoring

Ognimohub operates in full compliance with applicable Anti-Money Laundering (AML) and Counter-Financing of Terrorism (CFT) regulations. As part of our compliance obligations:

  • All transactions are subject to real-time and periodic monitoring for suspicious activity.

  • Ognimohub reserves the right to delay, block, freeze, or reverse any transaction suspected of violating AML/CFT regulations.

  • Ognimohub is legally obligated to file Suspicious Activity Reports (SARs) or Suspicious Transaction Reports (STRs) with relevant financial intelligence authorities. We are prohibited by law from notifying users when such reports have been filed.

  • Users must not structure transactions to circumvent reporting thresholds. Structured transactions are a criminal offence in most jurisdictions.

  • Ognimohub may freeze account balances pending regulatory investigation. Such freezes may not be disclosed to the account holder where prohibited by law.

13. Platform Security

Ognimohub employs a comprehensive, multi-layered security architecture to protect the platform and user data, including:

  • TLS 1.3 encryption for all data in transit between users and Ognimohub servers.

  • AES-256 encryption for data at rest in Ognimohub databases.

  • Multi-Factor Authentication (MFA) and Two-Factor Authentication (2FA) options for all account types.

  • Strong Customer Authentication (SCA) in compliance with PSD2 requirements where applicable.

  • Real-time fraud detection and transaction anomaly monitoring systems.

  • PCI DSS-compliant payment processing through certified PSP partners.

  • Regular independent security audits and penetration testing.

  • Zero-trust architecture and DevSecOps practices.

  • Tokenization of sensitive financial data to minimize exposure risk.

Notwithstanding the above, no digital platform can guarantee absolute security. Ognimohub strongly recommends that all users enable MFA on their accounts, use strong and unique passwords, and report any suspicious account activity immediately.


14. Privacy and Data Protection

The collection, processing, and storage of your personal data by Ognimohub is governed by our Privacy Policy, which is incorporated into these Terms by reference and available at:ognimohub.com/policy/privacy-policy

Ognimohub is committed to processing personal data in compliance with applicable data protection laws, including the GDPR for users in the European Economic Area. By using Ognimohub Services, you consent to the processing of your personal data as described in our Privacy Policy.

Your rights regarding the deletion of personal data are governed by our Data Deletion Policy, available at:

15. Intellectual Property

15.1 Ognimohub IP

All intellectual property rights in the Ognimohub platform, including but not limited to software, source code, algorithms, user interfaces, branding, trademarks, logos, trade names, documentation, and content (collectively, "Ognimohub IP"), are owned by or licensed to Ognimohub. Nothing in these Terms transfers any ownership of Ognimohub IP to you.


15.2 Limited License to Users

Ognimohub grants you a limited, personal, non-exclusive, non-sublicensable, non-transferable, revocable license to access and use the platform solely for the purposes contemplated by these Terms. This license does not permit you to copy, modify, distribute, sell, sublicense, or create derivative works from any Ognimohub IP.


15.3 User Content

Where you submit, upload, or provide content to Ognimohub (such as business profile information, promotional materials, or support communications), you grant Ognimohub a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content solely for the purpose of providing the Services. You represent that you own or have the right to submit such content and that it does not infringe any third-party rights.


15.4 Feedback

Any suggestions, feedback, or recommendations you provide regarding Ognimohub's Services may be used by Ognimohub without restriction, attribution, or compensation.


16. Third-Party Services and PSP Integrations

Ognimohub integrates with a network of third-party Payment Service Providers (PSPs), financial institutions, technology partners, and API providers (including Stripe, PayPal, Adyen, Paystack, Paytm, and others) to deliver its Services. You acknowledge and agree that:

  • Third-party PSPs and partners operate under their own terms of service and privacy policies, which are independent of Ognimohub's Terms.

  • Ognimohub is not liable for interruptions, errors, or failures in services caused by third-party providers.

  • Transaction fees, currency conversion rates, and processing times may be influenced by third-party PSP terms.

  • Ognimohub's Gateway Swap feature routes transactions through multiple PSP integrations. Transaction success is subject to the availability and policies of the selected gateway.

  • Ognimohub does not endorse, represent, or warrant the accuracy or reliability of any third-party service provider.

The Ognimohub platform may contain links to third-party websites or services. Such links are provided for convenience only. Ognimohub has no control over and accepts no responsibility for the content or practices of third-party sites.


17. Disclaimers, Limitations of Liability, and Indemnification

17.1 Service Disclaimer

Ognimohub Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, uninterrupted access, or error-free operation. Ognimohub does not guarantee that the platform will be free of errors, delays, or security vulnerabilities at all times.


17.2 Limitation of Liability

To the maximum extent permitted by applicable law, Ognimohub's total cumulative liability to you for any and all claims arising out of or relating to these Terms or the Services shall not exceed the total fees paid by you to Ognimohub in the three (3) months immediately preceding the event giving rise to the claim.

In no event shall Ognimohub be liable for:

  • Indirect, incidental, special, consequential, or punitive damages of any kind.

  • Loss of profits, revenue, business, data, or goodwill.

  • Losses arising from unauthorized account access resulting from your failure to maintain credential security.

  • Transaction failures, delays, or losses caused by third-party PSPs, banks, or payment networks.

  • Force majeure events, including but not limited to acts of God, natural disasters, governmental actions, pandemics, cyberattacks, or infrastructure failures.

  • Losses arising from your reliance on information or content accessed through the platform.


17.3 Indemnification

You agree to indemnify, defend, and hold harmless Ognimohub, its affiliates, directors, officers, employees, agents, and service providers from and against any claims, liabilities, damages, losses, penalties, fines, and expenses (including reasonable legal fees) arising from: (a) your use of the Services; (b) your breach of these Terms; (c) your violation of any applicable law or regulation; or (d) any third-party claim arising from your conduct on the platform.


18. Account Suspension and Termination

18.1 Termination by User

You may close your Ognimohub account at any time by following the account deletion process described in our Data Deletion Policy, available at ognimohub.com/policy/account-deletion. Prior to account closure, all outstanding transactions must be completed and any positive wallet balance must be withdrawn.


18.2 Suspension or Termination by Ognimohub

Ognimohub reserves the right to suspend, restrict, or terminate your account and access to Services, with or without prior notice, in the following circumstances:

  • Breach of any provision of these Terms or any applicable policy.

  • Suspected fraud, money laundering, terrorist financing, or other criminal activity.

  • Failure to complete KYC verification within required timeframes.

  • Provision of false, inaccurate, or fraudulent information during registration or transactions.

  • Regulatory directive, court order, or law enforcement instruction.

  • Reputational risk, including association with sanctioned entities or high-risk activities.

  • Inactivity exceeding the dormancy threshold specified in Section 6.3.


18.3 Effect of Termination

Upon termination of your account: (a) your license to use the platform is immediately revoked; (b) access to all Services is disabled; (c) any pending transactions will be processed or cancelled in accordance with the Transaction & Refund Policy; (d) wallet balances will be disbursed to your verified external account where possible, subject to regulatory holds and outstanding obligations; and (e) data retention and deletion will be handled in accordance with the Data Deletion Policy.


19. Dispute Resolution

19.1 Internal Dispute Resolution

If you have a dispute or complaint regarding Ognimohub's Services, you should first attempt to resolve it through Ognimohub's customer support channels. Ognimohub commits to acknowledging all formal complaints within 48 business hours and providing a substantive response within 10 business days:

19.2 Escalation and External Resolution

If an internal resolution cannot be reached, you may escalate your complaint to the relevant financial services regulatory authority or consumer protection body in your jurisdiction. Ognimohub will cooperate fully with any regulatory investigation or formal dispute process.


19.3 Governing Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction in which Ognimohub MFS is registered, without regard to conflict of laws principles. Any legal proceedings arising from these Terms shall be submitted to the exclusive jurisdiction of the competent courts of that jurisdiction, unless otherwise required by mandatory local law in your jurisdiction.


19.4 Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action. Ognimohub and users mutually waive the right to a jury trial for any claims arising under these Terms.


20. Force Majeure

Ognimohub shall not be held liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, civil unrest, strikes, governmental actions, sanctions, regulatory changes, pandemics, epidemics, power or telecommunications failures, cyberattacks, or failures of third-party service providers.

In the event of a force majeure event, Ognimohub will notify users as soon as reasonably practicable and will endeavor to restore Services as quickly as circumstances permit.


21. Regulatory Compliance and Sanctions

Ognimohub operates as a regulated financial services provider and complies with all applicable laws and regulatory requirements in the jurisdictions where it holds licenses or operates. Users are responsible for ensuring that their use of Ognimohub Services complies with all laws applicable in their own jurisdiction.

Ognimohub is prohibited from providing Services to individuals or entities subject to international sanctions, including those listed by the United Nations Security Council, the Office of Foreign Assets Control (OFAC), the European Union Consolidated Sanctions List, and equivalent national sanctions regimes. By using Ognimohub Services, you represent and warrant that you are not on any applicable sanctions list.


22. Amendments and Policy Updates

Ognimohub reserves the right to modify these Terms at any time to reflect changes in applicable law, regulatory requirements, business practices, or platform features. When material changes are made:

  • Registered users will be notified via in-app notification, email, or prominent notice on the platform prior to changes taking effect.

  • The updated Terms will be published at ognimohub.com/policy/terms-of-service with the revised effective date.

  • Continued use of Ognimohub Services after the effective date of changes constitutes acceptance of the revised Terms.

  • If you do not agree to the revised Terms, you must discontinue use of the Services and may close your account in accordance with Section 18.1.


23. Entire Agreement and Severability

These Terms, together with the Privacy Policy, Data Deletion Policy, KYC & AML Policy, Transaction & Refund Policy, Cookie Policy, and any applicable sub-platform or service-specific terms incorporated herein by reference, constitute the entire agreement between you and Ognimohub with respect to the subject matter hereof and supersede all prior agreements, representations, and understandings.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.

Ognimohub's failure to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.
