Welcome to Ognimohub. These Terms of Service ("Terms") govern your access to and use of the Ognimohub website, mobile applications, and all related services (collectively, the "Service" or "Platform") provided by Ognimohub Agency ("Ognimohub," "we," "us," or "our").


By accessing, browsing, or using any part of the Ognimohub Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies or guidelines incorporated herein. If you do not agree to these Terms, you must not access or use the Service.


PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS, INCLUDING LIMITATIONS, EXCLUSIONS, AND A BINDING DISPUTE RESOLUTION CLAUSE.


Ognimohub is a pioneering IT, Digital Marketing, and FinTech Agency dedicated to transforming the way individuals and businesses manage their financial interactions. We leverage advanced integrations with leading fintech and Payment Service Provider (PSP) APIs to deliver a comprehensive and seamless suite of financial services. Our platform serves users, agents, and merchants through a fully cross-platform Mobile Financial Services (MFS) solution enabling secure, scalable, and seamless digital financial transactions.


1.  Definitions

For the purposes of these Terms, the following definitions shall apply:


  • "Account" means the user account created by an individual or entity to access and use the Ognimohub Service.

  • "Agent" means an individual or entity duly authorized by Ognimohub to provide specific services on its behalf, including cash-in and cash-out operations.

  • "API" means Application Programming Interface.

  • "Content" means any data, text, graphics, images, audio, video, software, or other information made available through the Service.

  • "Fiat Currency" means government-issued currency not backed by a physical commodity.

  • "FinTech" means financial technology.

  • "Intellectual Property Rights" means all intellectual property rights, including copyrights, patents, trademarks, trade secrets, and other proprietary rights.

  • "Merchant" means a business or individual using the Ognimohub Service to accept payments for goods or services.

  • "MFS" means Mobile Financial Services.

  • "PSP" means Payment Service Provider.

  • "Public Holiday" means any day officially designated as a public, national, or bank holiday in the jurisdiction in which the transaction or user account is registered or operated.

  • "Service" or "Platform" means the Ognimohub website, mobile applications, and all related services.

  • "User" means any individual or entity that accesses or uses the Ognimohub Service, including registered users, Agents, and Merchants.

  • "Virtual Card" means a digital payment card issued for online transactions.


2.  Eligibility and Account Registration

2.1  Eligibility

To use the Ognimohub Service, you must be at least eighteen (18) years of age and possess the full legal capacity to enter into a binding contract under applicable law. By using the Service, you represent and warrant that you satisfy these requirements. Ognimohub reserves the right, at its sole discretion, to refuse service, terminate accounts, or cancel orders without liability.


2.2  Account Creation

Access to most features of the Service requires registration of an Account. By registering, you agree to:


  • Provide accurate, current, and complete information during registration and keep your Account information updated at all times.

  • Maintain the confidentiality and security of your password and login credentials.

  • Notify Ognimohub immediately at support@ognimohub.com upon becoming aware of any unauthorized use of your Account or any other breach of security.

  • Accept full responsibility for all activities occurring under your Account, whether authorized or unauthorized.


2.3  Identity Verification (KYC / AML Compliance)

In compliance with applicable anti-money laundering (AML) and know-your-customer (KYC) regulatory obligations, Ognimohub may require you to submit personal information, including but not limited to your full legal name, email address, residential address, phone number, and government-issued identification documents. We reserve the right to verify your identity through third-party verification services and to request supplementary documentation as deemed necessary. Failure to complete identity verification to our satisfaction may result in the suspension or permanent termination of your Account and any associated funds being held pending regulatory review.


3.  Privacy Policy and Data Protection

3.1  Data Collection

Ognimohub collects the following categories of data to operate and improve its services, ensure platform security, and fulfil regulatory obligations:


  • Files and Documents (Optional): Collected for application functionality.

  • Financial Information: Payment details, transaction history, and credit profile — collected for functionality, fraud prevention, compliance, and account management.

  • Personal Information: Name, email address, user IDs, address, and phone number — collected for functionality, communications, fraud prevention, security, compliance, and account management.

  • Messages (Optional): Emails, SMS, MMS, and in-app messages — collected for functionality, marketing communications, and account management.

  • Application Performance Data: Crash logs, diagnostics, and performance metrics — collected for analytics, fraud prevention, security, and compliance.

  • Application Activity (Optional): In-app interactions and search history — collected for functionality and analytics.

  • Contacts (Optional): Collected for application functionality.

  • Photos and Videos (Optional): Collected for functionality and account management.


3.2  No Third-Party Data Sharing

Ognimohub does not sell, rent, or share user data with third-party companies or organizations for commercial purposes. Your data is used solely for the purposes outlined in these Terms and our Privacy Policy.


3.3  Data Security

Ognimohub employs industry-standard technical and organizational safeguards to protect your personal information against unauthorized access, disclosure, alteration, and destruction. All data transmitted through the Platform is encrypted in transit using secure, industry-standard encryption protocols (TLS/SSL).


3.4  Data Deletion Requests

You have the right to request deletion of your personal data held by Ognimohub. Deletion requests may be submitted via the in-app settings or by contacting support@ognimohub.com. Upon receipt of a valid request, we will take all reasonable steps to delete your data from our active systems, subject to any overriding legal, regulatory, or contractual obligations to retain such information.


3.5  Privacy Policy

For a comprehensive understanding of how Ognimohub collects, processes, stores, and protects your personal information, please refer to our Privacy Policy, which is expressly incorporated by reference into these Terms.


4.  General Service Features and Policies

Ognimohub provides a comprehensive suite of Mobile Financial Services designed for seamless, secure, and scalable digital financial transactions. The following general policies apply to all features of the Platform. Feature-specific policies are stated within each subsection.


4.1  Add Money

Users may fund their accounts using a wide range of fiat and cryptocurrency payment methods, including over twenty (20) supported automated payment gateways (including Stripe and PayPal) as well as manual gateway options.


Add Money Policy

All funds added to a user's account must originate from legitimate, verifiable sources. Ognimohub reserves the right to request proof of funds and source-of-wealth (SoW) documentation at any time. Any attempt to deposit funds from suspicious, illicit, or unauthorized sources will result in immediate account suspension, freezing of the relevant funds, and mandatory reporting to applicable financial intelligence units and law enforcement authorities. Users bear sole responsibility for the legality and provenance of their funds.


4.2  Send Money

Users may transfer funds to any other registered Ognimohub user instantly and securely, anywhere on the Platform.


Send Money Policy

Users are solely responsible for verifying recipient details prior to initiating any transfer. Ognimohub assumes no liability for funds transferred to incorrect recipients as a result of user error. All transactions are subject to Ognimohub's fraud detection systems. Suspicious or high-risk transactions may be delayed, held, or permanently blocked, and accounts involved may be subject to investigation and suspension.


4.3  Mobile Recharge

Users may top up mobile credit and purchase airtime directly from the Platform.


Mobile Recharge Policy

Services are subject to the availability, pricing, and operating terms of the respective mobile network operators. Users must ensure the accuracy of the recipient mobile number before confirming the transaction. Confirmed recharge and airtime transactions are final and cannot be reversed.


4.4  Cash Out and Withdrawal Policy

Users may withdraw funds to a linked bank account or other permitted withdrawal method at any time, subject to the conditions outlined below.


Cash Out Policy

All withdrawal requests are subject to identity verification and may require additional compliance checks. Withdrawal limits apply based on account verification tier and applicable regulatory thresholds. Processing times vary depending on the selected withdrawal method and the policies of the receiving financial institution.


Public Holiday Withdrawal Restriction

Withdrawals, cash-out requests, and fund transfers are strictly prohibited on Public Holidays. Any attempt to initiate or process a withdrawal on a Public Holiday will be automatically declined. Repeated or deliberate attempts to circumvent this restriction shall constitute a breach of these Terms and will result in the immediate suspension of the relevant Account. Users are advised to plan withdrawals in advance of Public Holidays.


Investment Proceeds — Withdrawal Eligibility

Returns, profits, and principal amounts generated through Ognimohub investment plans are subject to the asset-class-specific rules set out in Section 4.13 (Investment Services). In summary: returns on standard Stocks plans are withdrawable on every return payout, while Promotional Stocks, Bonds, and ETFs remain locked until plan completion or maturity and subject to their respective review periods. Partial withdrawals, early redemptions, or any attempt to access locked funds ahead of schedule are strictly prohibited and shall constitute a material breach of these Terms. Once a plan clears its applicable lock-in and review period, proceeds will be credited to the user's wallet balance and become fully withdrawable in accordance with standard withdrawal policies, subject to the Public Holiday restriction above.


Ognimohub reserves the right to hold, reject, or reverse any withdrawal request where there are reasonable grounds to suspect fraud, money laundering, or any other illicit activity.


4.5  Make Payment

Users may pay for services, bills, or products through the Platform using their Ognimohub account balance.


Make Payment Policy

Users are responsible for verifying the accuracy of payment details, including merchant identity and payment amount, prior to confirmation. Ognimohub bears no responsibility for payments made to incorrect merchants or for incorrect amounts as a result of user error. Payments are generally irreversible once processed and confirmed.


4.6  Bank Transfer

Users may initiate direct fund transfers to any supported bank account.


Bank Transfer Policy

Bank transfers are subject to the operating hours, processing windows, and policies of the involved financial institutions. Users must provide complete and accurate bank account details; incorrect details may result in delays, failed transfers, or permanent loss of funds, for which Ognimohub shall bear no liability. Transaction limits and applicable fees apply as disclosed in the Fee Schedule. Bank transfers are prohibited on Public Holidays in accordance with the Cash Out Policy in Section 4.4.


4.7  Microfinance

Ognimohub provides access to short-term microfinancing options to assist users in managing their financial needs.


Microfinance Policy

Microfinance services are governed by separate terms and conditions, including eligibility criteria, applicable interest rates, repayment schedules, and late payment penalties. Users must review, understand, and expressly agree to those specific terms before accessing microfinance facilities. Ognimohub acts as a facilitator and may partner with licensed microfinance institutions to deliver these services.


4.8  Virtual Card

Users may generate virtual payment cards for secure online purchases and digital transactions.


Virtual Card Policy

Virtual cards are subject to specific usage limits, validity periods, and merchant acceptance restrictions. Users are solely responsible for the security of their virtual card credentials. Any unauthorized use of a virtual card must be reported to Ognimohub immediately at support@ognimohub.com. Virtual cards are designated for online transactions only and are not valid for point-of-sale or in-person transactions.


4.9  Utility Bill Payments

Users may pay utility bills including electricity, water, gas, and other services through the Platform.

Users are solely responsible for entering correct biller account details and reference numbers. Ognimohub bears no liability for late payment penalties or service disruptions arising from user error or delays attributable to the biller's own processing systems. Users should retain all payment confirmation receipts for their records.


4.10  Donation

Users may contribute to supported charitable causes directly through the Platform.


Donation Policy

All donations made through the Platform are final and non-refundable. Ognimohub does not guarantee any specific allocation or use of donated funds by the recipient organization. Users are encouraged to verify the legitimacy of charitable causes prior to donating.


4.11  Education Fee Payments

Users may pay school, college, or university fees for themselves or their dependants through the Platform.


Education Fee Policy

Users must ensure the accuracy of all student and institutional details prior to confirming payment. Ognimohub bears no liability for misdirected or delayed payments caused by user error or the educational institution's internal processing systems. Proof of payment should be retained by the user.


4.12  Two-Factor Authentication (2FA)

Ognimohub strongly recommends enabling Two-Factor Authentication (2FA) for all User accounts to provide an additional layer of security.


2FA Security Policy

Ognimohub shall not be liable for any financial loss or unauthorized access incurred where 2FA was not activated by the user or where the user's 2FA device or credentials were compromised through the user's own negligence. 2FA is mandatory for all Agent and Merchant accounts. Users are solely responsible for safeguarding their 2FA credentials and recovery codes.


4.13  Investment Services

Ognimohub offers users access to three categories of investment products — Stocks, Bonds, and Exchange-Traded Funds (ETFs). Each category has its own return mechanics, lock-in terms, and withdrawal timeline, as set out below.


Investment Policy — General

Investment services are subject to specific terms, conditions, risk disclosures, and disclaimers. Users acknowledge that all investments carry inherent risk, including the potential for partial or total loss of principal. Ognimohub provides access to investment opportunities and does not provide financial, investment, or advisory services. Users are strongly advised to conduct independent due diligence and seek qualified financial advice before making any investment decision. Past performance is not indicative of future results.


4.13.1  Stocks

Ognimohub offers structured Stocks investment plans across Daily, Weekly, Monthly, and Yearly return cycles, subject to the Plan Limits below. Returns generated on Stocks plans are withdrawable on every return payout and are credited directly to the user's wallet balance, subject to standard withdrawal processing and the Public Holiday restriction in Section 4.4.

Promotional Stocks — meaning any Stocks plan issued under a promotional, bonus, or incentive campaign — are excluded from the every-return withdrawal privilege above. Principal and returns on Promotional Stocks remain locked until the plan has generated all of its scheduled returns and reached completion. Once the plan is complete, a review period of forty-eight (48) hours applies before the funds become withdrawable to the user's wallet balance.


Investment Policy — Stocks Plan Limits (Effective January 2, 2026)

Daily Plans: One (1) active plan permitted at any time; maximum of one (1) plan per calendar month.

Weekly Plans: One (1) active plan permitted at any time; maximum of two (2) plans per calendar month.

Monthly Plans: Up to three (3) plans may run concurrently per calendar month.

Plan Progression: Upon completion of a plan, users may transition to a different plan category (e.g., Daily → Weekly → Monthly). If all categories have been utilized in the current cycle, users must contact Ognimohub Customer Support to request a plan eligibility reset.

Yearly Plans: No concurrent limit; users may hold up to twelve (12) active yearly plans simultaneously. This policy exists to ensure equitable access to investment opportunities while maintaining system integrity and regulatory compliance.


4.13.2  Bonds

Ognimohub offers fixed-term Bonds with defined maturity dates. All principal and returns invested in Bonds are locked and inaccessible until the Bond reaches full maturity. Upon maturity, a review period of seven (7) to fourteen (14) business days applies before matured funds are released and become withdrawable to the user's wallet balance. Early redemption, partial withdrawal, or any attempt to access Bond funds prior to maturity is strictly prohibited and constitutes a material breach of these Terms.


4.13.3  Exchange-Traded Funds (ETFs)

Ognimohub offers access to Exchange-Traded Fund (ETF) investment plans with defined maturity dates. All principal and returns invested in ETFs are locked and inaccessible until the ETF plan reaches full maturity. Upon maturity, a review period of three (3) business days applies before matured funds are released and become withdrawable to the user's wallet balance. Early redemption, partial withdrawal, or any attempt to access ETF funds prior to maturity is strictly prohibited and constitutes a material breach of these Terms.


Investment Policy — Lock-In Period and Withdrawal Restriction

Except for the every-return withdrawal privilege granted to standard (non-promotional) Stocks plans in Section 4.13.1, ALL investment plans — including Bonds, ETFs, and Promotional Stocks — are subject to a mandatory lock-in period. Invested principal and any accrued returns or profits under a locked plan shall remain strictly inaccessible until the relevant plan has fully matured, completed, and cleared its applicable review period. Withdrawals, cash-outs, bank transfers, or any form of utilization of locked investment funds prior to plan maturity are absolutely prohibited. Any violation of this policy — including unauthorized withdrawal attempts, account manipulation, or circumvention efforts — constitutes a material breach of these Terms and may result in account restrictions, forfeiture of all accrued returns and benefits, and permanent account termination without prior notice.


By enrolling in any investment plan, the User expressly acknowledges, understands, and agrees to be legally bound by the lock-in policy and all related terms herein.


4.14  Remittance

Users may send domestic and cross-border remittances to recipients through the Platform, including to bank accounts, mobile wallets, and cash-pickup locations supported by Ognimohub's licensed remittance partners.


Remittance Policy

Remittance transactions are subject to identity verification, sender and recipient KYC checks, and the transaction limits set out in Section 3.2. Ognimohub relies on licensed remittance and payment partners to complete cross-border transfers; processing times and applicable exchange rates are determined by those partners and disclosed to the user prior to confirmation. Ognimohub bears no liability for delays, rejected transfers, or unfavorable exchange rate movements arising from partner processing outside Ognimohub's control.

Remittances are unavailable on Public Holidays in accordance with the Cash Out Policy in Section 4.4. Users are solely responsible for verifying recipient details prior to confirming a remittance; Ognimohub bears no responsibility for funds sent to an incorrect recipient as a result of user error.


5.  User Application — Features and Policies

The Ognimohub User Application is designed for individual users to manage their personal financial activities in a simple, intuitive, and secure environment. All provisions of Section 4 (General Service Features and Policies) apply in full to User Application features and transactions.


6.  Agent Application — Features and Policies

6.1  Agent Eligibility and Onboarding

To become an authorized Ognimohub Agent, applicants must complete a rigorous vetting process, including background screening, identity verification, compliance training, and execution of the Agent Agreement. All Agents must hold any licenses and permits required by applicable local regulations prior to commencing operations.


6.2  Agent — Add Money

Agent Add Money Policy

Agents are subject to the same source-of-funds requirements as standard users but may be subject to enhanced due diligence, stricter transaction limits, and additional reporting requirements commensurate with their elevated operational role.


6.3  Agent — Cash In and Withdrawal

Agent Cash In & Withdrawal Policy

Agents must adhere strictly to Ognimohub's cash handling procedures and applicable regulatory requirements, including performing user identity verification for transactions exceeding prescribed thresholds, issuing proper transaction receipts, and maintaining accurate and complete transaction records. All discrepancies or suspicious activities must be reported to Ognimohub immediately. Agents bear sole responsibility for the physical security of cash holdings and their operational premises. Agent withdrawals and cash-out operations are subject to the same Public Holiday restrictions as standard users under Section 4.4.


6.4  Agent — Transaction Management

Agent Transaction Management Policy

Agents must process all transactions accurately and promptly. Agents are expressly prohibited from imposing unauthorized fees, manipulating transaction parameters, or misrepresenting transaction details. All agent transactions are subject to periodic audit by Ognimohub's compliance team.


6.5  Agent — Statement Access

Agent Statement Access Policy

Agents must maintain strict confidentiality of all user transaction data and may only access records necessary to fulfil their authorized duties. Unauthorized disclosure, reproduction, or misuse of transaction data constitutes a serious breach of these Terms and will result in immediate termination of the Agent Agreement, potential legal action, and reporting to applicable regulatory authorities.


6.6  Agent — Two-Factor Authentication

Agent 2FA Policy

Two-Factor Authentication is mandatory for all Agent accounts. Agents are fully responsible for the security of their 2FA devices and credentials. Any account compromise attributable to an Agent's failure to implement and maintain adequate 2FA security shall be the Agent's sole liability.


6.7  Agent Conduct Standards

All Agents must conduct their operations professionally, ethically, and in strict compliance with Ognimohub's policies and applicable local laws. This includes treating users with respect, providing accurate and complete information, and refraining from any deceptive, fraudulent, or non-compliant practices at all times.


7.  Merchant Application — Features and Policies

7.1  Merchant Eligibility and Onboarding

To become an authorized Ognimohub Merchant, businesses must complete the merchant application and vetting process, including business entity verification, regulatory compliance checks, and execution of the Merchant Agreement. All Merchants must hold valid business licenses and permits required under applicable law.


7.2  Payment Acceptance

Merchant Payment Acceptance Policy

Merchants must display Ognimohub as an accepted payment method in accordance with Ognimohub's branding guidelines. Merchants are prohibited from imposing surcharges on Ognimohub-processed payments unless explicitly authorized by applicable law and prior written consent from Ognimohub. All merchant transactions are subject to Ognimohub's fraud monitoring systems.


7.3  Customer Transaction Management

Merchant Transaction Management Policy

Merchants must maintain the confidentiality of all customer payment data and may only use such data for legitimate business purposes directly related to the relevant transaction. Merchants are solely responsible for handling customer disputes and processing refunds in accordance with their stated return policies and applicable consumer protection legislation.


7.4  Promotions and Discounts

Merchant Promotions Policy

Merchants are solely responsible for the terms, conditions, fulfilment, and accuracy of all promotions and discounts offered through the Platform. All promotional activities must comply with applicable advertising laws and regulations. Ognimohub accepts no responsibility for merchant promotional claims or their fulfilment.


7.5  Transaction History and Reconciliation

Merchant Transaction History Policy

Merchants must regularly reconcile their Ognimohub transaction history with their internal financial records. Any discrepancies must be reported in writing to Ognimohub within thirty (30) calendar days of the transaction date. Failure to report within this period may affect the ability to investigate or resolve the discrepancy.


7.6  Merchant — Two-Factor Authentication

Merchant 2FA Policy

Two-Factor Authentication is mandatory for all Merchant accounts. Merchants are responsible for securing their 2FA devices and credentials. Account compromise due to inadequate 2FA security shall be the Merchant's sole liability.


7.7  Merchant API and Platform Integration

Merchant API / Plugin Policy

Merchants integrating via Ognimohub APIs or third-party plugins (including WordPress, Shopify, and Magento) must adhere to Ognimohub's API usage guidelines and security best practices. Merchants are responsible for the security of their integrated systems and for ensuring their API usage complies with all applicable data protection, privacy, and security laws. Unauthorized distribution, publication, or misuse of API keys is strictly prohibited and will result in immediate account suspension and potential legal action.


7.8  Merchant Invoice

Merchants may generate, send, and track digital invoices to customers directly through the Ognimohub Merchant App for goods or services rendered.


Merchant Invoice Policy

Merchants are solely responsible for the accuracy of all invoice details, including itemized charges, applicable taxes, and payment due dates. Invoices generated through the Platform are for record-keeping and payment-collection purposes only and do not constitute a Ognimohub guarantee of payment.

Merchants must retain invoice records in accordance with applicable tax and accounting laws. Disputes regarding invoiced amounts must be resolved directly between the Merchant and the customer, save that Ognimohub may assist with underlying transaction records where a payment was processed through the Platform. Unpaid or overdue invoices are the sole responsibility of the Merchant to pursue; Ognimohub does not provide collections or debt-recovery services.


8.  Customer Support Policy

Ognimohub is committed to delivering professional and timely customer support. To ensure all inquiries are handled efficiently and fairly, users must adhere to the following support engagement standards.


8.1  Single-Channel Communication

Users must direct their support inquiries through a single designated communication channel per issue. Ognimohub provides support via the following channels:

Multi-Channel Communication Policy

Submitting the same query, complaint, or request across multiple support channels simultaneously ("multi-channelling") is strictly prohibited. Multi-channelling creates duplicate case records, delays resolution times for all users, and disrupts the support queue. Ognimohub reserves the right to close duplicate inquiries and to deprioritize support requests from users who engage in repeated multi-channelling behaviour. Users who persistently violate this policy may have their support access restricted.


8.2  One Ticket Per Issue

Duplicate Ticket Policy

Users must submit only one (1) support ticket per issue or inquiry. Submitting multiple tickets for the same matter is prohibited and will result in duplicate tickets being merged or closed without response. If your ticket has not been acknowledged within the published response window, you may follow up on your existing ticket rather than creating a new one. Ognimohub support response times are published in the Help Centre and may be affected by public holidays, high-volume periods, or unforeseeable circumstances.


8.3  Support Conduct

Users are expected to engage with Ognimohub support staff in a respectful and professional manner. Abusive, threatening, or harassing communications will not be tolerated and may result in the termination of the support interaction and restriction of the user's Account.


9.  Fees and Charges

9.1  Service Fees

Ognimohub may charge fees for certain services, including but not limited to transaction processing fees, withdrawal fees, currency conversion fees, and subscription fees for premium features. All applicable fees will be disclosed to you clearly before you complete a transaction or subscribe to a service.


9.2  Amendments to Fee Schedule

Ognimohub reserves the right to modify its fees and charges at any time. We will provide reasonable prior notice of material fee changes by posting an updated Fee Schedule on our website or through in-app notifications. Your continued use of the Service following such notification constitutes acceptance of the revised fees.


9.3  Tax Obligations

You are solely responsible for all taxes, duties, withholdings, and levies imposed by any governmental or regulatory authority in connection with your use of the Ognimohub Service. Ognimohub does not provide tax advice and recommends consulting a qualified tax professional.


10.  Prohibited Activities

The following activities are expressly prohibited on the Ognimohub Platform. Engaging in any prohibited activity may result in immediate account suspension, termination, forfeiture of funds, and referral to law enforcement authorities:


  • Using the Service for any illegal, fraudulent, or unauthorized purpose, including money laundering, terrorist financing, tax evasion, or any other criminal activity.

  • Violating any applicable laws, regulations, or the rights of any third party.

  • Engaging in conduct that is harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.

  • Attempting to gain unauthorized access to the Service, other user accounts, or any computer systems or networks connected to the Platform.

  • Interfering with or disrupting the integrity, security, or performance of the Service or its underlying infrastructure.

  • Introducing malicious code, including but not limited to viruses, Trojan horses, worms, logic bombs, ransomware, or spyware.

  • Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.

  • Collecting or harvesting personally identifiable information from the Service without explicit, prior consent.

  • Reverse engineering, decompiling, disassembling, or otherwise attempting to derive or reconstruct the source code, algorithms, or underlying logic of the Service.

  • Using automated tools, scripts, bots, or scrapers to access the Service in a manner exceeding what a human user can reasonably generate through normal use.

  • Submitting multiple support tickets for the same issue or contacting support through multiple channels simultaneously for the same query (see Section 8).

  • Attempting to circumvent the Public Holiday withdrawal restriction or the investment lock-in period (see Sections 4.4 and 4.13).


11.  Intellectual Property

11.1  Ognimohub Content

All content on the Ognimohub Platform — including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software — is the exclusive property of Ognimohub Agency or its licensed content suppliers and is protected under applicable international copyright, trademark, and other intellectual property laws.


11.2  Limited Licence

Subject to your compliance with these Terms, Ognimohub grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your personal or internal business purposes. This licence does not include the right to: (a) resell or commercially exploit the Service or its contents; (b) collect, copy, or use product listings, pricing, or descriptions for the benefit of third parties; (c) create derivative works; (d) copy account information for external use; or (e) use data mining tools, bots, or scraping utilities.


11.3  User Content

You retain ownership of content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant Ognimohub a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, reproduce, distribute, modify, display, and perform such User Content in connection with the operation, promotion, and improvement of the Service and Ognimohub's related business activities.


12.  Third-Party Services and Links

The Ognimohub Service may integrate with or contain links to third-party websites, applications, or services (e.g., Stripe, PayPal, and other payment gateways). These third-party services are neither owned nor controlled by Ognimohub. Ognimohub assumes no responsibility for the content, privacy practices, availability, accuracy, or reliability of any third-party services. You acknowledge that Ognimohub shall not be liable, directly or indirectly, for any loss or damage arising from your use of, or reliance on, any third-party content, products, or services. We strongly recommend reviewing the terms of service and privacy policies of any third-party services you access.


13.  Disclaimers and Limitation of Liability

13.1  Disclaimer of Warranties

THE OGNIMOHUB SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. OGNIMOHUB DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVERS HOSTING THE SERVICE ARE FREE OF HARMFUL COMPONENTS.


13.2  Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OGNIMOHUB AGENCY AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED AND WHETHER OR NOT OGNIMOHUB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.


13.3  Aggregate Liability Cap

IN NO EVENT SHALL OGNIMOHUB'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE TOTAL AMOUNT PAID BY YOU TO OGNIMOHUB DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH THE CLAIM AROSE.


14.  Indemnification

You agree to defend, indemnify, and hold harmless Ognimohub Agency, its affiliates, licensors, service providers, officers, directors, employees, contractors, agents, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and legal fees arising from or relating to: (a) your violation of these Terms; (b) your use of the Service in a manner not expressly authorized herein; (c) your User Content; or (d) your violation of any applicable law or the rights of any third party.


15.  Governing Law and Dispute Resolution

15.1  Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.


15.2  Binding Arbitration

Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be finally resolved by binding arbitration administered by the Nairobi Centre for International Arbitration (NCIA) in accordance with its applicable rules. The seat and venue of arbitration shall be Nairobi, Kenya. Proceedings shall be conducted in the English language. The arbitral award shall be final, binding, and enforceable in any court of competent jurisdiction.


15.3  Class Action Waiver

To the fullest extent permitted by applicable law, you agree that all disputes shall be resolved on an individual basis only. You waive any right to: (a) consolidate your dispute with any other proceeding; (b) pursue any dispute on a class-action or representative basis; or (c) seek relief on behalf of the general public.


16.  Termination

16.1  Termination by Ognimohub

Ognimohub may terminate or suspend your Account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to: breach of these Terms; engagement in fraudulent, unlawful, or prohibited activities; failure to satisfy KYC/AML requirements; violation of the Support Policy (Section 8); or any conduct that Ognimohub reasonably determines to be harmful to the Platform, its users, or third parties.


16.2  Termination by User

You may terminate your Account at any time by submitting a written request to support@ognimohub.com. Account termination requests will be processed in accordance with our data retention and regulatory obligations.


16.3  Effect of Termination

Upon termination, your right to access and use the Service will immediately cease. Provisions of these Terms that by their nature survive termination — including but not limited to ownership, warranty disclaimers, indemnification, and limitations of liability — shall remain in full force. Any outstanding balance, obligations, or pending investigations will continue to be subject to these Terms notwithstanding termination.


17.  Changes to These Terms

Ognimohub reserves the right, at its sole discretion, to modify or replace these Terms at any time. Where a revision is material, we will provide not less than thirty (30) days' notice prior to the new terms taking effect, by posting the revised Terms on our website or issuing an in-app notification. What constitutes a material change shall be determined at Ognimohub's sole discretion. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of and agreement to be bound by those revised Terms. If you do not agree to the amended Terms, you must cease using the Service.


18.  Miscellaneous Provisions

18.1  Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or supplementary agreements published by Ognimohub on the Service, constitute the entire agreement between you and Ognimohub with respect to the Service and supersede all prior and contemporaneous understandings, agreements, and representations.


18.2  Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitral tribunal of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.


18.3  Waiver

No waiver of any provision of these Terms shall be deemed a continuing or future waiver of that provision or any other provision. Ognimohub's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.


18.4  Assignment

You may not assign or transfer your rights or obligations under these Terms without Ognimohub's prior written consent. Any purported assignment without consent shall be null and void. Ognimohub may freely assign or transfer its rights and obligations under these Terms without restriction.


18.5  Force Majeure

Ognimohub shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil disturbance, governmental action, pandemics, embargoes, fire, flood, earthquake, or failures of third-party infrastructure, utilities, or telecommunications networks.
